Meeting of the Government Council on Thursday, November 28, 2024
The Government Council met on Thursday, 25 Jumada Al-Awwal 1446 (November 28, 2024), under the chairmanship of the Head of Government, Mr. Aziz Akhannouch. The meeting was dedicated to the review of several legal texts, in accordance with Article 92 of the Constitution.
- At the beginning of its session, the Government Council reviewed and approved Draft Law No. 55.24, amending and supplementing Law No. 62.99 establishing the Code of Financial Jurisdictions. This draft law was presented by Mr. Fouzi Lekjaa, the Minister Delegate to the Minister of Economy and Finance, responsible for the Budget.
This draft law aligns the provisions of Law No. 62.99 with the updates introduced by Organic Law No. 14.22, which amends and supplements Organic Law No. 106.13 on the status of magistrates. The status of magistrates in financial jurisdictions now mirrors that of other magistrates, particularly regarding grades, ranks, and salary indices.
The draft aims to supplement Articles 165 and 192 of Law No. 62.99 by introducing a new grade, titled "Senior Grade," above the exceptional grade. This measure takes effect retroactively from March 23, 2023, aligning with the enforcement of similar provisions for magistrates under Organic Law No. 14.22. - The Government Council then reviewed and approved Draft Decree No. 2.24.770, supplementing Decree No. 2.23.690 of 1 Jumada II 1445 (December 15, 2023). This decree implements Law No. 60.22 on the basic mandatory health insurance (AMO) scheme for individuals able to pay contributions but not engaged in salaried or non-salaried activities. It was presented by Mr. Amine Tahraoui, Minister of Health and Social Protection.
This draft decree complements the implementation of Article 14-bis of Law No. 60.22, executed through Dahir No. 1-23-41 of 5 Dhu al-Qi'dah 1444 (May 25, 2023), and further refined by Law No. 21.24 promulgated via Dahir No. 1.24 of 18 Muharram 1446 (July 24, 2024). Its aim is to expand Article 7-bis of Decree No. 2.23.690 to outline the mechanisms for verifying the enrollment of insured individuals eligible under the AMO scheme and the regularity of their contribution payments to the National Social Security Fund (CNSS) to enable them to benefit from public subsidies and assistance. - The Council also reviewed and approved Draft Decree No. 2.24.402 regarding the implementation of Section III of Chapter IV, Title I, of the law on nuclear and radiological safety and security. This law also concerns the establishment of the Moroccan Agency for Nuclear and Radiological Safety and Security and addresses the application of safeguards under the Treaty on the Non-Proliferation of Nuclear Weapons. The decree was presented by Ms. Leila Benali, Minister of Energy Transition and Sustainable Development.
This draft aims to define the prerequisites for the communication of information to the Agency regarding installations, locations, and the import/export of related materials and technologies. It also seeks to establish provisions for a national system of accounting and control of nuclear materials managed by the Agency, along with necessary measures for national and international inspections conducted by inspectors from the International Atomic Energy Agency (IAEA).
